This agreement
These Terms of Service (the “Terms”) govern your use of SeeMeNot — the website at seemenot.com, the browser service it provides, and everything connected to them (together, the “Service”). In these Terms, “SeeMeNot”, “we” and “us” mean the operator of the Service, and “you” means the person or organisation using it.
By creating an account, paying for a plan, or using the Service in any way, you agree to these Terms. If you do not agree, do not use the Service.
Our Privacy Policy explains what we collect and what we do with it. It forms part of these Terms.
What the service is
SeeMeNot runs a web browser on our own servers and streams the picture of it to the browser you already have. You control it from your screen; the browsing itself happens on our hardware, not on your device.
Each tab you open is given its own network exit address, its own device fingerprint and its own separate cookie and storage area, so that activity in one tab is not linked to activity in another by the sites you visit.
What we do not promise. Some websites deliberately refuse traffic that arrives from server address ranges, and some detect and block automated or privacy-protecting browsers regardless of what we do. We cannot guarantee that any particular website will load, function fully, or allow you to sign in. This is a characteristic of the wider internet, not a fault in the Service, and it is not a ground for a refund.
The Service is a tool for private browsing. It is not a security product, it is not anonymity insurance, and it does not make you untraceable. Nothing about it removes your responsibility for what you do while using it.
Who may use it
- You must be at least 18 years old.
- You must have the legal capacity to enter into a binding contract.
- You must not be barred from receiving the Service under any law that applies to you, and you must not be located in, or ordinarily resident in, a country or territory subject to comprehensive trade sanctions, nor appear on any applicable restricted-party list.
- If you are agreeing on behalf of a company or other organisation, you confirm you are authorised to bind it, and “you” means that organisation.
Your account and seats
You need an account to use the Service. You agree to give accurate registration details and to keep them up to date.
You are responsible for everything that happens under your account, including activity by anyone you give access to. Keep your password to yourself, use one that is not reused elsewhere, and tell us promptly at support@seemenot.com if you believe your account has been used without your permission.
Some plans include more than one seat. A seat is for one named individual. Seats may be reassigned when someone leaves, but they may not be shared, rotated between people to increase capacity, passed around, sub-licensed, rented or resold.
Acceptable use
The Service exists so that ordinary, lawful browsing can be kept private and kept separate. It is not a shield for wrongdoing, and privacy features do not make an unlawful act lawful.
You must not use the Service to do, attempt, assist or encourage any of the following:
- Break any law, regulation or sanctions regime that applies to you or to us.
- Commit or facilitate fraud, including payment fraud, card testing, fake reviews, fake engagement, deceptive advertising, or any scheme designed to mislead a person or a platform for gain.
- Access any account, computer, network or data that you are not authorised to access, or attempt to evade a ban, block, suspension or other access-control measure imposed on you personally by a third party.
- Create or operate accounts on another service in breach of that service's rules where doing so is unlawful, deceptive, or intended to cause harm.
- Send spam or unsolicited bulk messages, or harvest contact details for that purpose.
- Distribute malware, run phishing pages, or stage attacks against any system.
- Handle, seek or distribute child sexual abuse material, or any content that sexualises a minor. We report this to the authorities without notice and without exception.
- Harass, stalk, threaten, dox or target any individual.
- Infringe anyone's intellectual property, or misappropriate trade secrets or confidential information.
- Scrape, crawl or extract data in a way that breaks the law, breaches a binding contract, or places an unreasonable load on the target.
- Interfere with the Service itself — probing, load-testing, reverse-engineering, circumventing limits or protections, extracting our software, or degrading it for other customers.
- Resell, rebrand, or provide the Service to third parties as your own without our written permission.
We do not routinely monitor what you browse. But if we receive a credible report, a legal demand, or see evidence of the above, we may investigate and act under section 12.
Session limits and fair use
The Service runs on shared hardware, so some limits are technical rather than commercial. As at the date of these Terms:

| Idle pause | A session with no one connected to it pauses itself shortly afterwards. Paused time is not billed. |
| Maximum session length | A session is closed automatically after a maximum continuous period, and a long-paused session is shut down. Unsaved work in the browser is lost when this happens. |
| Fair use | Sustained use far beyond normal interactive browsing — automation at scale, continuous transfer, or anything that degrades the Service for others — may be throttled or stopped. |
These limits may change as the Service changes. Where a change would materially reduce what your paid plan gives you, we will tell you before it takes effect.
Plans, metering and billing
Plans are assembled from seats, a monthly allowance of data, and a number of saved profiles. Prices are shown on the pricing page before you buy, and the price shown at checkout is the price charged.
How we meter
- Time counts only while you are actually connected to a running browser. Idle, paused and disconnected time is not counted.
- Data counts traffic that passes through your private network connections. The video of the screen streamed back to you is not counted against your data allowance.
Both meters are visible in your dashboard. Our records of usage are the ones we bill from. If you think a figure is wrong, contact us and we will look into it in good faith.
Payment
Payment is taken by card through our payment provider. Plans renew automatically for the same period — monthly or yearly — unless cancelled before the renewal date. By subscribing, you authorise these recurring charges.
Taxes are your responsibility unless we state otherwise. If a payment fails, we may retry it and may suspend the Service until it succeeds.
We may change prices. Changes apply from your next renewal, and we will give you notice before they take effect, so you can cancel first if you would rather not continue.
Cancelling and refunds
You can cancel at any time. Cancelling stops the next renewal; your plan then runs to the end of the period you have already paid for, and access ends after that.
Refunds. Payments already made are final and non-refundable, in whole or in part. This includes unused time, unused data, unused seats and part-used periods. Cancelling does not produce a refund for the current period.
Nothing here removes any right you have under consumer protection law that cannot be excluded by contract. If we cancel your plan for a reason that is not your fault under section 12, we will refund the unused remainder of the current period.
Your data and content
What you browse, type and save while using the Service is yours. We do not claim ownership of it.
By default, a browser session keeps nothing: when it ends, its history, cookies, cache and storage are destroyed. If you switch on the saved-browsing option in your dashboard, we keep that profile so your logins survive to the next session, and it is stored in encrypted form on our disks.
Switching saved browsing off does not delete the stored profile immediately. It is retained for a period in case you switch it back on, and is then deleted automatically. Deleting your account removes your saved profiles.
You are responsible for the lawfulness of what you do and store. Do not use saved profiles to hold material you are not entitled to hold.
The Privacy Policy sets out what we can and cannot see, and what we keep. Please read it — it is deliberately specific about the limits of what encryption protects.
Availability and change
We work to keep the Service running, but we do not offer a guaranteed uptime level. Maintenance, upgrades, hardware failure, network problems and events outside our control can all interrupt it.
We may add, change or withdraw features. If we withdraw something material that your paid plan relies on, we will give you reasonable notice and you may cancel and receive a refund of the unused remainder of the current period.
Third-party sites and providers
The Service is used to reach websites we do not run. We are not responsible for their content, their conduct, their terms, or what they do with information you give them. Your dealings with them are between you and them.
We rely on third parties for parts of the Service, including payment processing, network transit and email delivery. Their handling of data is covered in the Privacy Policy.
Suspension and termination
We may suspend or terminate your access, with or without notice depending on the seriousness, if:
- you breach these Terms, and in particular section 5;
- your payment fails or your account falls into arrears;
- we are required to by law, by a court, or by a regulator;
- your use threatens the security, stability or lawful operation of the Service, or the safety of another person.
Where the circumstances allow it, we will tell you what the problem is and give you a chance to put it right. For the most serious matters — in particular child sexual abuse material, or activity that puts a person in danger — we act immediately and without notice.
You may close your account at any time from your dashboard or by contacting us. On termination your right to use the Service stops, and sections 13 to 17 and 19 survive.
Intellectual property
The Service, the software behind it, the SeeMeNot name, the three-monkeys mark and the site design are ours or our licensors'. Using the Service gives you a limited, personal, non-exclusive, non-transferable, revocable right to use it as intended, and nothing more.
You may not copy, modify, distribute, sell, lease, reverse-engineer or attempt to extract the source of any part of the Service, except to the extent that restriction is prohibited by law.
If you send us feedback or suggestions, we may use them freely and without obligation to you.
Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, THAT ANY PARTICULAR WEBSITE WILL BE REACHABLE OR USABLE THROUGH IT, OR THAT IT WILL PREVENT ANY PARTICULAR FORM OF TRACKING, IDENTIFICATION OR DETECTION.
Some jurisdictions do not allow certain warranties to be excluded, so parts of this section may not apply to you.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, NOR FOR LOST PROFITS, LOST REVENUE, LOST BUSINESS, LOST GOODWILL, OR LOST OR CORRUPTED DATA, HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY.
OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).
These limits do not apply to liability that cannot be limited by law, including for fraud or for death or personal injury caused by negligence. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
Indemnity
You agree to defend, indemnify and hold us harmless from any claim, demand, loss, liability or expense (including reasonable legal fees) arising out of your use of the Service, your breach of these Terms, or your violation of any law or the rights of any third party.
Governing law and disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. You and we agree to the exclusive jurisdiction of the state and federal courts located in Delaware, and each of us waives any objection to venue there.
Before starting formal proceedings, please contact us at support@seemenot.com and give us thirty days to resolve the matter. Most problems are settled faster that way.
Changes to these terms
We may update these Terms. The “last updated” date at the top always shows the current version. If a change materially affects your rights, we will give reasonable notice — by email, or by a notice in the Service — before it takes effect.
Continuing to use the Service after a change takes effect means you accept the updated Terms. If you do not accept them, cancel before they take effect.
General
- Entire agreement. These Terms and the Privacy Policy are the whole agreement between us about the Service, and replace anything said or written before.
- Severability. If any provision is held unenforceable, the rest stays in force and the provision is applied to the maximum extent permitted.
- No waiver. If we do not enforce a right, we do not give it up.
- Assignment. You may not assign these Terms without our written consent. We may assign them to a successor in connection with a merger, acquisition or sale of assets.
- Force majeure. Neither of us is liable for failure caused by events beyond reasonable control.
- No agency. These Terms do not create a partnership, agency, employment or joint venture between us.
